C\u2019est un \u00e9norme avantage pour l\u2019acheteur par rapport \u00e0 d\u2019autres syst\u00e8mes, comme en France par exemple, o\u00f9 il faut faire le tour des agences pour voir ce qu\u2019il y a en magasin.<\/p>\n<p>Il existe de nombreuses fa\u00e7ons d\u2019acc\u00e9der aux donn\u00e9es du MLS, notamment par les sites de certaines agences immobili\u00e8res. Attention,<strong> l\u2019acc\u00e8s est GRATUIT<\/strong>. Fuyez donc les sites qui vous proposent de payer pour y acc\u00e9der.\u00a0<strong>Exemple d\u2019acc\u00e8s :<\/strong> <i class=\"fa fa-link\" aria-hidden=\"true\"><\/i> <a href=\"http:\/\/Realtor.com\" target=\"_blank\" rel=\"noopener noreferrer\">Realtor.com<\/a><\/p>\n<p>Il est \u00e0 noter que le MLS contient \u00e9galement les offres \u00e0 la location.<\/p>\n<h2>2\/ L\u2019offre de prix<\/h2>\n<p>Une fois que vous avez rep\u00e9r\u00e9 le bien en question, vous devez proposer une offre \u00e9crite, accompagn\u00e9e d\u2019un <strong>premier versement<\/strong>, compris entre $5,000 et 10% du montant de l\u2019offre. Bien entendu, cet argent est d\u00e9pos\u00e9 sur un compte s\u00e9questre (<strong>Escrow Account<\/strong>) et il vous est int\u00e9gralement restitu\u00e9 si l\u2019offre est refus\u00e9e, \u00e0 condition toutefois d\u2019avoir dans votre contrat de vente, une clause suspensive qui le pr\u00e9voit.<\/p>\n<h2>3\/ Les inspections<\/h2>\n<p>Une fois l\u2019offre accept\u00e9e, vous pouvez demander une <strong>inspection d\u00e9taill\u00e9e des lieux<\/strong> (Home Inspection), \u00e0 vos frais. Si l\u2019inspection est satisfaisante, vous devrez placer sur le m\u00eame compte s\u00e9questre, une somme additionnelle, comprise <strong>entre 10% et 20%<\/strong> du bien.<\/p>\n<h2>4\/ Le financement<\/h2>\n<p>L\u2019acheteur peut bien \u00e9videmment choisir soit d\u2019acheter son bien immobilier comptant, soit d\u2019avoir recours \u00e0 un financement. Dans ce dernier cas, l\u2019obtention d\u2019un<strong> cr\u00e9dit<\/strong> peut prendre un certain d\u00e9lai, entre 45 et 60 jours environ. Pendant ce temps, la banque pr\u00eateuse va surement demander une <strong>estimation du bien<\/strong> en question, aupr\u00e8s d\u2019un organisme sp\u00e9cialis\u00e9 et ind\u00e9pendant. Cette estimation \u00e9crite (appraisal) est un indicateur pr\u00e9cieux pour la banque, qui sait, d\u00e8s lors, si le prix d\u2019achat que vous proposez est pertinent. Sachant qu\u2019elle risque de se retrouver avec votre bien sur les bras si vous ne remboursez pas votre cr\u00e9dit, elle v\u00e9rifie sa valeur marchande \u2026 dor\u00e9navant.<\/p>\n<p>En effet rappelons que gr\u00e2ce \u00e0 nos amis les banquiers, depuis les d\u00e9buts de l\u2019affaire des <strong>\u00ab <em>subprimes<\/em> \u00bb<\/strong> en 2006\/2007, la plus grande partie de notre monde vit une crise \u00e9conomique majeure. (Voici un bon lien vers une BD corrosive qui circulait dans les bureaux des grandes banques de NY avant que l\u2019affaire ne devienne un sujet grand public : document PDF sur <i class=\"fa fa-link\" aria-hidden=\"true\"><\/i> <a href=\"http:\/\/rue89.com\" target=\"_blank\" rel=\"noopener noreferrer\">rue89.com<\/a>).<\/p>\n<p>Vous pouvez aussi proc\u00e9der de mani\u00e8re inverse, c\u2019est-\u00e0-dire commencer par obtenir un financement, ou savoir si vous \u00eates \u00e9ligible \u00e0 b\u00e9n\u00e9ficier d\u2019un cr\u00e9dit pour une somme donn\u00e9e, ainsi, vous deviendrez <strong>\u00ab <em>pr\u00e9-qualifi\u00e9<\/em> \u00bb<\/strong> (pre-qualified) et pourrez ensuite prospecter le march\u00e9 avec une id\u00e9e pr\u00e9cise de votre budget.<\/p>\n<p><strong>Deux situations peuvent alors se pr\u00e9senter :<\/strong><\/p>\n<ul>\n<li>Le financement n\u2019est pas obtenu dans ce d\u00e9lai l\u2019acheteur a la possibilit\u00e9 d\u2019annuler le contrat et de r\u00e9cup\u00e9rer son apport.<\/li>\n<li>Le financement est obtenu dans ce d\u00e9lai, les deux parties peuvent alors cl\u00f4turer la vente.<\/li>\n<\/ul>\n<h2>5\/ La cl\u00f4ture de la vente ou closing<\/h2>\n<p>Une fois que le financement a \u00e9t\u00e9 obtenu, la cl\u00f4ture de la vente (Closing) se fait g\u00e9n\u00e9ralement dans les jours suivants.\u00a0D\u00e8s lors, intervient un <strong>agent de cl\u00f4ture<\/strong> (Closing Agent ou Settlement Agent) qui :<\/p>\n<ul>\n<li>Repr\u00e9sente l\u2019acheteur dans le transfert du titre et le transfert de propri\u00e9t\u00e9 du vendeur vers l\u2019acheteur.<\/li>\n<li>Effectue les recherches de validit\u00e9 sur le titre de propri\u00e9t\u00e9.<\/li>\n<li>Propose l\u2019assurance de ce titre (Owner\u2019s Title Insurance Policy). Concr\u00e8tement, cette assurance garantit l\u2019\u00e9tat du titre de propri\u00e9t\u00e9 \u00e0 un moment donn\u00e9.<\/li>\n<li>Synchronise le paiement des fonds \u00e0 travers son compte s\u00e9questre.<\/li>\n<li>Les co\u00fbts de closing pour l\u2019acheteur varient entre 1.5% (Achat comptant) et 4% du prix d\u2019achat (achat financ\u00e9).<\/li>\n<\/ul>\n<h2>6\/ Les frais et les droits : Qui paye quoi ?<\/h2>\n<p><strong><span style=\"text-decoration: underline\">A la charge du vendeur<\/span> :<\/strong><\/p>\n<ul>\n<li>Les frais d\u2019agence, dans la tr\u00e8s grande majorit\u00e9 de ce type de transactions, Droits d\u2019enregistrements : $0.6 pour chaque tranche de $100.<\/li>\n<li>R\u00e9actualisation de l\u2019assurance de l\u2019acte de propri\u00e9t\u00e9 : de $200 \u00e0 $250.<\/li>\n<li>Frais d\u2019avocat (facultatifs) : de $400 \u00e0 $600.<\/li>\n<\/ul>\n<p><strong><span style=\"text-decoration: underline\">A la charge de l\u2019acheteur<\/span> :<\/strong><\/p>\n<p>En France, le cadastre permet d\u2019identifier les<strong> propri\u00e9t\u00e9s fonci\u00e8res<\/strong> des communes et garantit la preuve de la propri\u00e9t\u00e9 de chacun. Aux Etats-Unis, un tel registre n\u2019existe pas c\u2019est pourquoi il vous est conseill\u00e9 de prendre une <strong>assurance sur votre titre propri\u00e9t\u00e9<\/strong>, pour se pr\u00e9munir contre les \u00e9ventuelles erreurs d\u2019enregistrement.<\/p>\n<h3><strong>2 types de situations<\/strong><strong> :<\/strong><\/h3>\n<p><strong><span style=\"text-decoration: underline\">Achat financ\u00e9<\/span> :<\/strong><\/p>\n<ul>\n<li>Assurance du titre : 0.7% du prix d\u2019achat.<\/li>\n<li>Analyse de votre cr\u00e9dit ou \u00ab Credit Report \u00bb : de $60 \u00e0 $100.<\/li>\n<li>Inspections : de $250 \u00e0 $400.<\/li>\n<li>Expertise de la valeur v\u00e9nale ou \u00ab Appraisal \u00bb : de $200 \u00e0 $300.<\/li>\n<li>Droits d\u2019enregistrement : 0.35% et 0.2% du montant du cr\u00e9dit.<\/li>\n<li>Pour une maison individuelle, il faut souscrire une assurance multirisque habitation : 14 mois \u00e0 payer \u00e0 l\u2019avance en principe.<\/li>\n<li>Pour un bien dans un immeuble : 2 \u00e0 4 mois de frais de copropri\u00e9t\u00e9s \u00e0 payer d\u2019avance.<\/li>\n<li>Relev\u00e9 cadastral : $300.<\/li>\n<li>Frais d\u2019avocat : de $1 000 \u00e0 $1 500.<\/li>\n<li>Honoraires de banque : 1% \u00e0 3% du montant du cr\u00e9dit.<\/li>\n<li>Frais de dossiers : de $200 \u00e0 $400.<\/li>\n<li>Frais de greffe : de $40 \u00e0 $100.<\/li>\n<li>Imp\u00f4ts fonciers: 2 \u00e0 10 mois \u00e0 payer d\u2019avance.<\/li>\n<\/ul>\n<p><strong><span style=\"text-decoration: underline\">Achat comptant<\/span> :<\/strong><\/p>\n<p><strong>Ces frais sont recommand\u00e9s mais ne sont pas obligatoires :<\/strong><\/p>\n<ul>\n<li>Assurance du titre : 0.7% du prix d\u2019achat.<\/li>\n<li>Inspections : de $250 \u00e0 $400.<\/li>\n<li>Relev\u00e9 cadastral : $300.<\/li>\n<li>Frais d\u2019avocat : de $1 000 \u00e0 $1 500.<\/li>\n<\/ul>\n<p>Et ce n\u2019est pas fini\u2026<\/p>\n<p><strong><span style=\"text-decoration: underline\">Frais de copropri\u00e9t\u00e9<\/span> :<\/strong> Dans le cas de l\u2019<strong>achat d\u2019une propri\u00e9t\u00e9<\/strong> en r\u00e9sidence ferm\u00e9e (Gated community) ou d\u2019un bien dans un immeuble (Condominium), vous \u00eates redevable des frais de copropri\u00e9t\u00e9 (Maintenance fees).
