Vandormael, Carlton Fields<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t<\/a>\r\n\t\t\t<\/div>\t\t\r\n\t\t<\/div>\r\n\t<\/div>Acqu\u00e9rir une propri\u00e9t\u00e9 \u00e0 titre individuel<\/h2>\n<p>Un \u00e9tranger qui <strong>investit dans l\u2019immobilier aux \u00c9tats-Unis<\/strong>,\u00a0sans planifier au pr\u00e9alable, s\u2019expose aux pi\u00e8ges de la <strong>fiscalit\u00e9 am\u00e9ricaine<\/strong>, surtout s&#8217;il d\u00e9cide d\u2019acqu\u00e9rir le bien immobilier \u00e0 titre personnel.<\/p>\n<p>Dans ce cas pr\u00e9cis, si l\u2019investisseur <strong>\u00e9tranger<\/strong> d\u00e9cide de faire don de son bien (ex : le rajout d\u2019une autre personne au titre de propri\u00e9t\u00e9), le don sera soumis \u00e0 un imp\u00f4t sur la donation de l\u2019ordre de 40% (2014), apr\u00e8s un abattement de 14.000 dollars.<\/p>\n<p>De la m\u00eame fa\u00e7on, en cas de d\u00e9c\u00e8s, l\u2019investisseur \u00e9tranger sera soumis \u00e0 un <strong>imp\u00f4t<\/strong> sur la succession de l\u2019ordre de 40% ((2021) sur la valeur marchande du<strong> bien immobilier<\/strong> au moment de son d\u00e9c\u00e8s, apr\u00e8s un abattement maximum de 60,000 dollars.<\/p>\n<p>De plus, l\u2019identit\u00e9 de l\u2019investisseur \u00e9tranger sera r\u00e9v\u00e9l\u00e9e dans les archives publiques du comt\u00e9 o\u00f9 la propri\u00e9t\u00e9 est situ\u00e9e. Le patrimoine personnel de l\u2019investisseur \u00e9tranger ne sera pas prot\u00e9g\u00e9 en cas de poursuites des locataires ou d\u2019autres cr\u00e9anciers.<\/p>\n<h2>Vente ou location de son bien immobilier<\/h2>\n<p>Si l\u2019investisseur \u00e9tranger vend son bien immobilier, il devra faire face aux r\u00e8gles de FIRPTA (\u00ab<em> Foreign Investment in Real Property Tax Act<\/em> \u00bb) qui exigent que 15% du prix de vente d\u2019une propri\u00e9t\u00e9 aux \u00c9tats-Unis soient retenus par l\u2019acheteur et vers\u00e9s aux autorit\u00e9s fiscales (\u00ab <em>Internal Revenue Service<\/em> \u00bb) \u00e0 moins que certaines conditions soient r\u00e9unies.<\/p>\n<p>Si le<strong> bien immobilier<\/strong> est mis en <strong>location<\/strong>, les loyers bruts seront soumis \u00e0 des retenues d\u2019imp\u00f4ts \u00e0 la source de 37% (2021).
