{"id":95946,"date":"2014-02-18T19:00:00","date_gmt":"2014-02-18T23:00:00","guid":{"rendered":"https:\/\/frenchdistrict.com\/new-york\/articles\/carte-verte-investir-entreprise-eb5\/"},"modified":"2022-07-18T14:01:41","modified_gmt":"2022-07-18T18:01:41","slug":"carte-verte-investir-entreprise-eb5","status":"publish","type":"post","link":"https:\/\/frenchdistrict.com\/new-york\/articles\/carte-verte-investir-entreprise-eb5\/","title":{"rendered":"S\u2019offrir une carte verte"},"content":{"rendered":"<p>Cr\u00e9\u00e9 dans les ann\u00e9es 1990, le programme \u00ab\u00a0<em>EB-5<\/em>\u00a0\u00bb a pour objectif de promouvoir l\u2019investissement de capitaux \u00e9trangers sur le territoire am\u00e9ricain, tout en cr\u00e9ant des emplois pour les nationaux.<\/p>\n<h2>Il existe deux possibilit\u00e9s pour obtenir une carte verte en tant qu\u2019investisseur :<\/h2>\n<ul>\n<li>Le \u00ab\u00a0<em>million dollars investor visa<\/em>\u00bb, comme son nom l\u2019indique, permet \u00e0 un entrepreneur \u00e9tranger d\u2019obtenir une carte verte en investissant un million de dollars dans une entreprise commerciale aux USA. Ce type d\u2019investissement exige que l\u2019investisseur soit actif au sein de l\u2019entreprise et qualifi\u00e9, il doit investir dans son domaine d\u2019expertise. Attention, pour obtenir la carte verte permanente, l\u2019entrepreneur doit, \u00e0 la fin des deux ans, prouver qu\u2019il a cr\u00e9\u00e9 au minimum dix emplois. De plus, l\u2019activit\u00e9 commerciale de la compagnie doit rester la m\u00eame, pendant ces deux ans, et co\u00efncider avec le \u00ab\u00a0<em>Business plan<\/em>\u00a0\u00bb fourni lors de la demande de carte verte temporaire.<\/li>\n<\/ul>\n<ul>\n<li>Il existe une seconde option qui permet d\u2019 \u00ab\u00a0<em>acheter<\/em>\u00a0\u00bb une carte verte tout en \u00e9tant un investisseur passif. Il faut dans ce cas investir 500,000. dollars (soit environ 370,000 euro) dans des centres r\u00e9gionaux, qui sont des entreprises priv\u00e9es accr\u00e9dit\u00e9es par l\u2019immigration. Attention, \u00ab\u00a0<em>\u00eatre accr\u00e9dit\u00e9<\/em>\u00a0\u00bb par l\u2019immigration ne garantit absolument pas que la carte verte soit accord\u00e9e. L\u2019avantage de cette proc\u00e9dure est le candidat n\u2019a pas besoin d\u2019\u00eatre un entrepreneur ou un businessman et d\u2019avoir des comp\u00e9tences particuli\u00e8res. Il n\u2019y a pas non plus de limite d\u2019\u00e2ge ; Ainsi, un parent peut effectuer cette d\u00e9marche pour ses enfants, m\u00eame mineurs.<\/li>\n<\/ul>\n<p>Peu importe le type de \u00ab<em>\u00a0EB-5<\/em>\u00a0\u00bb et le montant de l\u2019investissement, la demande de carte verte par l\u2019investissement s\u2019effectue toujours en deux \u00e9tapes :<\/p>\n<ul>\n<li>D\u2019abord, il faut soumettre le formulaire I-526 \u00ab\u00a0<em>Immigrant petition by Alien entrepreneur<\/em>\u00a0\u00bb. Durant cette \u00e9tape, il faut prouver le montant de l\u2019investissement, et l\u2019origine des fonds. Il est essentiel que l\u2019origine des fonds soit connue et l\u00e9gale, pour recevoir l\u2019approbation du dossier. En effet en r\u00e9action aux abus, ce programme avait \u00e9t\u00e9 ferm\u00e9 en 1998 avant d\u2019\u00eatre r\u00e9organis\u00e9 en 2003.<\/li>\n<\/ul>\n<ul>\n<li>Une fois le formulaire I-526 approuv\u00e9, il faut faire une demande d\u2019ajustement de statut I-485, pour obtenir la carte verte. Cette carte vous permet de r\u00e9sider aux Etats-Unis pour une p\u00e9riode conditionnelle de deux ans. Au bout de deux ans, pour obtenir la carte verte permanente, il faut prouver que la compagnie dans laquelle l\u2019investissement a \u00e9t\u00e9 fait, a cr\u00e9\u00e9 et maintenu au minimum dix nouveaux emplois \u00e0 temps plein (occup\u00e9s par des Am\u00e9ricains).<\/li>\n<\/ul>\n<h2>Nos astuces :<\/h2>\n<ul>\n<li>Contrairement aux autres cartes vertes sujettes \u00e0 des quotas, et donc \u00e0 des d\u00e9lais d\u2019obtention importants, le nombre d\u2019EB-5 demand\u00e9s chaque ann\u00e9es est faible par rapport au nombre disponibles.
